EDMONTON _ The parents of a slain Alberta Mountie have made one last legal bid to keep their son's body close to home.

Lawyer Sid Tarrabain, acting for the parents of Const. Leo Johnston, told the Alberta Court of Appeal that the RCMP officer was buried near his parent's home in Lac La Biche, Alta., and his body should remain there.

But Chelsey Bailey, acting for Johnston's widow, Kelly, says her client wants her husband's body buried in Regina at the site of a national RCMP cemetery.

In court documents, Kelly Johnston has said that's the way her husband would have wanted to be immortalized, while the Mountie's mother says her son's body should remain near that of his ancestors.

Johnston and three other RCMP officers were killed by gunman James Roszko on his farm near Mayerthorpe, Alta., in March 2005 before Roszko turned the gun on himself.

Justice Frans Slatter reserved decision in the case and didn't specify a date when he would hand down a decision. (CTV Edmonton) © 2008 The Canadian Press
